Murali Pillai on Lease Agreements for Retail Premises Bill

The introduction of a Bill to level the playing field between landlords and retail tenants represents a “significant shift” in the Government’s position from several years ago as it rethinks the “moral limits of markets”. Expressing this view in Parliament on Thursday (Aug 3), MP Murali Pillai said the COVID-19 pandemic appears to have been the catalyst for this change, leading to a recognition that free market principles are “not the holy grail of public policy” but must bend to the larger principles of public life. He identified those principles as equality, fairness and true autonomy in contracting. Mr Murali did seek several clarifications on the dispute resolution mechanisms proposed under the Bill. He asked about the qualifications that will be required for mediators and adjudicators as well as details of the powers of adjudicators.
