Sun Xueling on rendering conviction records spent under Section 377A
People whose records under Section 377A have not been automatically rendered spent may apply to the Commissioner of Police to have them treated as spent. The Commissioner will consider whether the case was a private activity and whether it was between consenting adults. The other factors to be considered will not be different from those of other applications to render criminal records spent, such as the severity of the offence and the applicant’s conduct following the conviction.
