Hany Soh on Mental Capacity (Amendment) Bill
With an omission in the electronic Lasting Power of Attorney (LPA) form exposing thousands of documents to potential legal challenges, the Office of the Public Guardian has been transparent in accounting for the mistake and swift in remedying the potential consequences, said MP Hany Soh. In Parliament on Tuesday (Apr 2), she sought several clarifications. First, whether any of the 87,000 affected LPA donors had since become mentally incapacitated. Second, whether all affected parties have been directly notified and what assistance they have been given. Third, whether affected donors and/or donees will be allowed to relook the LPAs and make amendments at no charge. Fourth, whether hard copies and certified true copies of affected LPAs remain valid with no need for re-application or re-issuance.
