A Conditional Fee Agreement (CFA) does not really mean “no win, no fee” because the client will still have to pay some costs, such as for filing. What constitutes success in a case and when exactly an “uplift” fee will apply may also not be clear to the public. Making these points in Parliament on Wednesday (Jan 12), NMP Raj Joshua Thomas asked that the Ministry of Law consider drawing up templates that are easily understood by the layman and that could be mandated for use by lawyers when they discuss CFAs with clients. He also suggested that the ministry provide guidelines on the risk assessment lawyers should undertake in considering whether to offer CFAs, and on what terms.
