Divorce by mutual agreement can reduce acrimony and the emotional toll on a divorcing family, but is there a risk that divorce will become too easy? This question was posed by MP Sylvia Lim in Parliament on Monday (Jan 10) during the debate on the Women’s Charter (Amendment) Bill. She noted that allowing mutual agreement is to do away with some of the more onerous criteria for traditional grounds for divorce, such as minimum time requirements set for unreasonable behaviour, desertion or separation. Ms Lim also expressed concern about how the rights of spouses and children will be safeguarded in cases where spouses have unequal bargaining power or only one side has legal representation. She said it is critical for the court to play a watchdog role for any vulnerable parties.
