Louis Ng on Post-appeal Applications in Capital Cases Bill
The new provisions in the Post-appeal Applications in Capital Cases Bill will clarify the procedures for appeal cases and the factors that the court has to consider in granting permission, said MP Louis Ng. Speaking in Parliament on Tuesday (Nov 29), he said given the serious nature of capital cases, it is critical that due process is in place to ensure that applications for prisoners awaiting capital punishment are heard. Such processes and the grounds for any decision must be clear and transparent, he added. He also sought clarifications on the Bill. He wanted to know on what grounds or under what circumstances the court will exercise its power to take additional evidence. He wanted to know what the standard of reasonable prospect of success entails. He also wanted to know what factors the court should consider in determining if an application is an abuse of process.
