The laws must keep pace with changing behaviour and technology but they must be clear, proportionate and fair, said MP Diana Pang. Speaking in parliament on Tuesday (Aug 4), she pointed out that drivers acting reasonably should not be unintentionally caught by the law. For example, a phone may slip from a holder, and the driver instinctively picks it up and places it somewhere safe without looking at the screen or operating any function. She urged the government to clarify how the law would apply in such situations. Ms Pang also highlighted an issue of consistency - a driver may spend several seconds typing on a mounted phone, entering a destination into a navigation system, which can be as distracting as holding a phone. She asked if the government should also consider criminalising the act of operating a mounted device while driving.
