Will the authorities exercise some form of discretion not to prosecute owners or tenants who might be “put on the spot” by a proposed new law which places the onus on them to prove their innocence in cases of high-rise littering? MP Dennis Tan raised concerns about the “presumption clause” in Parliament on Monday (Feb 6). He gave examples of landlords being unfairly held responsible for an adult tenant, parents not wishing to inform on their children, and the likelihood of distress, disputes, incidents of intimidation or even abuse arising. Mr Tan also asked about the basis for which surveillance cameras are installed to catch litterbugs in the act. He wanted to know if there has to be a minimum number of complaints received about a particular unit or culprits, and what other criteria are considered.
