He Ting Ru on Constitution and Penal Code Amendment Bills relating to Section 377A

“I do not believe we should have a law in the books that is plainly and obviously discriminatory”, said MP He Ting Ru in supporting the repeal of Section 377A of the Penal Code which criminalises sex between men. She said it contradicts the national pledge to build a democratic society based on justice and equality, is at odds with steps that Singapore is taking to be a fairer and more equitable society for all, and goes against the Government’s announcement that it will legislate against discrimination. However, on the proposed constitutional amendment to protect marriage, Ms He said she objected to sub-sections that prevent laws and policies relating to the heterosexual definition of marriage from being challenged in court on the basis of the fundamental liberties provisions in the Constitution. What then, she asked, would stop a future Parliament from passing discriminatory legislation and then shielding it from judicial oversight? Ms He spoke in Parliament on Tuesday (Nov 29).
